The Structure of the State (1) In the Federal Republic of Somalia, the state is composed of two levels of government: (a) The Federal Government Level; (b) The Federal Member States Level, which is comprised of the Federal Member State government, and the local governments. (2) No single region can stand alone. Until such time as a region merges with another region(s) to form a new Federal Member State, a region shall be directly administered by the Federal Government for a maximum period of two years. Article 49. The Number and Boundaries of the Federal Member States and Districts (1) The number and boundaries of the Federal Member States shall be determined by the House of the People of the Federal Parliament. (2) The House of the People of the Federal Parliament, before determining the number and boundaries of the Federal Member States, shall nominate a national commission which shall study the issue, and submit a report of its findings with recommendations to the House of the People of the Federal Parliament. (3) The nomination of the commission referred to in Clause 2 shall be preceded by the enactment of a law by the House of the People of the Federal Parliament, which shall define: (a) The responsibilities and powers of the commission; 13PROVISIONAL CONSTITUTION (b) The parameters and conditions it shall use for the establishment of the Federal Member States; © The number of the commissioners, requirements of membership, nomination methods, office tenure, and their remuneration. (4) The number and the boundaries of the districts in a Federal Member State shall be determined by a law enacted by the parliament of the Federal Member State, which must be approved by the House of the People of the Federal Parliament. (5) Federal Member State boundaries shall be based on the boundaries of the administrative regions as they existed before 1991. (6) Based on a voluntary decision, two or more regions may merge to form a Federal Member State. The constitution doesnt stands in the way of forming Federal States based on the existing Provinvial regions. So there is no need to create clan states, new boundries, break-up of cities or regions. This will save Somalia the chaos, headache, outside interverence and confusion that forming Clan States will bring. What we have seen the past couple of months in Kismayo, for sure will be repeated in Baidoa, Beletweyn, Jowhar, Marka, Dhusamareeb, etc. The Federal Goverment needs to put an end to the forming of "new regions and States" by declaring that Somalia will be administred the coming 2 years based on the excisting Provincial regions. And after two years the country will organise a democratic referendum where each citizens can decide on the fate and future destiny of their Provinces (join State A, State B, etc). This will give Somalia some time to liberate the country from AL Shabaab, return of stability and security and rebuilding the country before heading in to the heated national debate of Clan&States. That region has been, still is and will always be Somalia my young friend and what you consider history?, i Lived it! my name is odey remember?. You can never deny facts, This region has in fact been troublesome and President Hassan sheikh should appoint a Governor for this region who is more Nationalistic than this Treasonous one!, maybe even make this aging one stand on trial for Treason? .........hmm I wonder...
