Confusing' articles in Somalia draft constitution

GAROWE, Somalia May 12 2012 (Garowe Online) - On Friday the Puntland government said that a number of articles in the Somalia draft constitution were "confusing and contradictory", Garowe Online was able to attain some of the articles in question.

 

In a press release on Friday, the Puntland government said a six member review committee reviewed the Somalia draft constitution and concluded that it was designed for a highly centralized government and some articles in the constitution need to be amended.

 

Furthermore the Puntland government said that the Somalia draft constitution should not be presented to the National Constituent Assembly (NCA), until changes are made and agreed upon by Somali stakeholders.

 

Here are some articles that the Puntland government wanted amended: Article 45 (Natural Resources) says, “The Federal Parliament shall legislate laws

governing the sharing of natural resources, such as hydrocarbons, minerals

and issuance of fishing permits between the Federal Government, Member

States and District Administrations.”

 

The Puntland government stated that this article violated the federal system and requested this article be removed until member states negotiate on the issue of natural resources. Officials in Puntland say before a constitution could be signed articles like these need to be clarified.

 

Another article in question was the Number of People's Assembly article 88: “A specific law shall define the procedure to come up with the final number of members of the People’s Assembly.”

 

This article breaks the previous agreements signed in Garowe and Mogadishu which sets the number of the People's Assembly, also called the Lower House, to 225 MPs.

 

In the Somalia draft constitution paragraph 2, in article 113 says, that a presidential candidate must relinquish his foreign nationality prior to standing election. Over 20 years of civil war in Somalia has forced many Somalis to flee their native land and live as Diaspora. Analysts say that a large amount of Diaspora are involved in Somali politics and hold key positions. The Puntland government requested the removal of that paragraph.

 

The Somalia draft constitution according to analysts who spoke to Garowe Online was rushed to meet a deadline. The TFG's executive branch were working on the constitution for 8 months after the initial draft along with a Committee of Experts (CoE) and the Independent Federal Constitution Commission (IFCC). The Somalia draft constitution has been presented to audiences in Minnesota and Ohio. However limited consultations to Somalis both in Somalia and out, weak attendance and a time squeeze failed to garner the discussions warranted to make the consultation process legitimate.

 

According to the Wardheernews agency, "A committee appointed to visit cities with large Somali populations, and hold consultative meetings to get feedback on the Somalia draft constitution, failed to publicize those meetings and did not receive much turnout."

 

Although the TFG held consultation meetings and told participatory groups that the draft constitution has the potential to evolve, but there is an article that restricts amendments for a period of 7 years after the NCA votes to adopt the constitution.

 

A local source says a total of 10 pages of changes and removals were submitted to the TFG. The TFG have been adamant that opposition to the Somalia draft constitution will not be tolerated but the Puntland government says serious lack of clarity and contradictory articles have forced the Puntland government to act now.
