Monday 28, March,2011 (HOL) The Somali Parliamentary Committee on Constitution and Federal affairs has opposed the one year extension of the tenure of the current Interim Federal government of Somalia, with the chairman of the committee describing it as a move to scuttle the parliament's extension of term in February this year.

 

Sheikh Jama Haji Hussein, the chairman of the Parliamentary Committee on Constitution and Federal Affairs, told the media Monday, that the extension of the tenure of the Transitional Federal Government came too late and was supposed to have been made before the parliament had passed its own extension of term.

 

'' I think this late decision by the government to extend its tenure of office is misguided because it seems the government intends to use this move to invalidate the parliament's recent extension of tenure,'' said Sheikh Jama.

Moreover, the Parliamentary Committee on Constitution and Federal Affairs said that it had asked the government to submit its plan early this year , with no feedback from the government side on this, prompting the parliament to make its decision to extend its term by three more years.

 

'' The government is required to make sure that it finishes its work before August this year when its tenure of office comes to an end, but should not make itself busy with work that does not fall under its mandate'', added the chairman.

 

Mr Sheikh Jama told reporters that the Somali parliament was ready to assist the government complete its work in time before the August 2011 deadline.

 

'' It is good to follow the constitution of our country both in spirit and letter, but should not be used to please personal interests. The government should accept the parliament's earlier decision'', said Seikh Jama who also added that the parliament would go a head with the election it had earlier called for.

 

Finally, the chairman of the parliamentary Committee on Constitution and Federal Affairs called on the Somali president and Speaker of parliament should follow the constitution when he was asked about the dispute between the two most senior leaders in the country..

The U.N. representative to Somalia says a crisis is unfolding over the efforts by the country's parliament and government to extend their terms, and that the international community "doesn't buy" the government's argument for extending itself beyond its August mandate.

 

The Horn of Africa country has been at war for two decades, and the weak, U.N.-backed government has for years controlled just a few blocks of the capital. Basic services are mostly unavailable and residents often are caught in the middle of clashes between government-backed troops and insurgents.

 

Then Somalia's Cabinet said Sunday that it also wants a one-year extension so it can continue governing through a military offensive against al-Qaida-linked militants — a battle launched last month in which African Union and Somali forces seem to be making gains.

 

The U.N.'s Somalia representative, Augustine P. Mahiga, said in an interview that Somalia's government is suffering a constitutional crisis even as pro-government forces claim to have captured up to 75 per cent of Mogadishu. "Ironically, as these military successes are being recorded on the ground, there have been disturbing political developments," Mahiga said.

 

Mahiga said that even before the weekend announcement by Somalia's cabinet, the government had been asking the international community for more time. "The international community did not buy the argument of the government, and instead wants to see elections in July, Mahiga said.

 

Parliamentarians said they, too, would not back a Cabinet extension and called on President Sheik Sharif Sheik Ahmed to instead seek his extension through an election. The Cabinet extension requires parliament's approval.

 

Somalia's government has long been embroiled in internal wrangling, especially between the executive and the legislature. Ahmed is not on good terms with the parliament speaker, Sharif Hassan Sheik Aden, who didn't consult the president — or the international community — over parliament's plan to vote itself a three-year extension. Somalia's parliament has little effect on the lives of average Somalis. It hasn't passed any laws in the last six years, and one of its biggest achievement so far has been refurbishing the parliament building.

 

The U.S. called that February self-extension "self-serving political manoeuvring."

The country's 550 members of parliament are paid $600 a month — a decent sum in Somalia — but are trying to get that increased to $1,500 a month, Mahiga said.

Mahiga said the international community is open to a one-year extension for parliament, but would like to see a new government voted in by August.

 

The duration of that new government would be determined by the adoption of an interim constitution. The challenge, Mahiga said, is for everyone to agree on a constitution, which parliament and government leaders said can be finished within a year. But in yet another twist likely to upset the international community, Mahiga said parliament's position is that the implementation of that new constitution would have to wait until parliament's three-year extension has expired. Because the international community pays for almost everything related to Somalia's government, one option is for donors to simply stop sending money to Mogadishu. But while Mahiga said that is an option, "we don't want to paralyze these institutions."

 

Whether the Cabinet gets more time or not — which doesn't seem likely — the political wrangling is unlikely to affect international support for the African Union forces leading the charge against al-Shabab. But Mahiga noted that military gains must be coupled with political leadership.

 

It has to be a political solution and the political part of it has to be performed by government," he said. "And really, by removing the government partner who is supposed to provide the leadership in the struggle against al-Shabab you are literally spelling defeat to the whole exercise."

Before jumping into the point of the article, we would like to gratefully acknowledge the genuine effort being made by the addressee of this essay, and sadly apologize any inconvenience they may encounter along the course. To that end, we are writing this column to express our stand regarding the issue of the self-allotted term extension by the Somalia��s fragile government and/or legislators, and also their cynical opposition of the subject matter (the proposed conference to be held in Nairobi anytime this month).

 

However, in reference to the international standard of government, a legitimate government is one that can provide mutual defense for the fundamental rights for those to be governed, and that can deal with its own internal affairs with or without external assistance. Ironically though, after seven years of life-support by the international community through AMISOM, Somalia��s parliament and the government alike are unwisely giving themselves tenure extension! At the time, when what is at stake is bare survival or minimum liberty of its members against the very people they represent, let alone the rest of the country. Therefore, to add our sermon into the discourse, the Somali intellectuals both at home and up-road are calling upon:

 

�� The Somali parties, the frail parliament/government and tribe-based regional authorities such as Galmudug, Puntland, Somaliland, the newly announced Azania in the south to unconditionally attend the upcoming Nairobi conference on April 12th 2011 which we believe will effectively iron-out and ultimately unravel the chronic conflict of the nation.

 

��The UN, US and UK in conjunction with other international partners, to use their economical leverage in bringing the beneficiaries together and broadening the participation scope for possible substitute, had anyone of those above mentioned groups decides not to attend. Since the Somali people are now prepared to bypass and no longer beholden to an inert structure of government or tribally oriented unitary antagonists.
