The Next Conflict In Somaliland

First anyone familiar with an automobile can easily identify that the parts must work properly if the driver wants to get to his destination: the battery, the engine, the tires, the steering, the transmission, the brakes, and, of course, dozens of other me­chanical parts most of us never see. The air conditioning, the radio, or the safety belts, though desirable, are certainly not indispensable compo­nents. We (Somali Landers) need to work exactly the same as the mechanics of car if we need to reach quickly in our destination as a democratically recognised country. We are inaugurating in slow pace from traditional system to democratic system. Basically it is marriage between traditional way of dealings to democratic system and it requires enormous time to evolve. Evolvement in our political attitudes, political preference Our political socialization is a should be as tool to facilitate on understanding democratic values and in during this process our government which it’s aim (even though those who politically matured during bare’s regime does not known it) is to mediate the various contending groups with bounds and promulgate the rules and settle disputes and remove elements that generating conflict and strength and encourage those that contribute social harmony and resolving problems in amicable way is another important aim of the government activity.

 

 

 

Constitutions reflect the values, beliefs and the preferred political path of the people that a country aims to follow. Constitutions are also expected to be egalitarian (a belief that all people are equal and should have equal rights and opportunity under law) and Somaliland constitution is not exempted to attain these worldly upheld beliefs. As we stated in our constitution, we have opted to follow and implement Islamic sharia and the democratic values that as concur rents with sharia. The refusal of the Somaliland government to register a new political party in Somaliland as stated by the Somaliland ruling party is deprivation of the rights of the Somaliland citizens to organise their political belief .it is an irony to see that this two parties are banning from other Somaliland citizens form the vary way that they to came to exist as political party in Somaliland.

 

 

 

Laws are made by the legislators and executive branch implements it and judiciary punished those violated the rule but if any flaws emerges out from the constitution then Judiciary should have send to the legislators to amend rather then hastening unnecessary action that diminishes in our international stand. On the other hand opposition parties should stop vilifying the potential development of ruling party and emulate through conductive way of manifesting their development programme and point the needs to be addressed in the country. That is that but what is the next conflict that emerging from constitution? Let be known that it will be after presidential election why? Look let me briefly explain Electoral system in Somaliland then you see what I am saying.

 

Ballots are extensively nowadays used as a device for transforming an ordinary citizen into public official and it also provides state officials with certificate of legitimacy.

 

The primary function of the ballot is to empower and enable the citizens to opt for from one candidate to another and vest the chosen candidate with authority to make rules and formulate policies and another imperative function of the ballot is to service as controlling mechanism and it is the threat of losing in the next election makes elected officials heeds the complaints and admonitions of ordinary citizen between elections.

 

 

 

1- The current operational electoral system of Somaliland has flaws, ambiguity and needs to re-examine it again before next presidential elections. Let us examine the electoral systems we have for the upcoming elections in our countries. Technically electoral systems are categories into two major groups.

 

 

 

1. Majoritarian.

 

2. Proportional Representation (PR).

 

 

 

Majoritarian is also known as Single Member District (SMD) and has two types:

 

SMD with Plurality and SMD with Majority

 

 

 

SMD with plurality –Candidates receiving the comparatively largest block of valid votes – even if this plurality consists of only one vote- is elected.

 

 

 

SMD with majority - Candidate must receive more than 50% of the valid votes, it is fine when two candidates are compete but if there is more than two candidate as happened in last presidential election then, the two largest block compete run off to win over fifty percent of valid votes. Does that happen in Somaliland? Or is the next emerging conflict after presidential election in Somaliland? Why am I saying this? Look what our electoral system says

 

 

 

Obviously the red marked word in the rule of the electoral system which states majority system, is the next conflict Somaliland.

1. Habka doorashooyinka degaanada wuxuu noqonayaa Habka isu qiyaasidda saamiyada kuraasta iyo tirada codadka uu xisbi/urur ka helo gobol ama degmo (proportional representative system). Hasa yeeshee doorashada Madaxweynaha iyo Ku xigeenka Madaxweynaha waxay noqonaysaa habka aqlabiyadda hal-dheeriga ah (majority system), sida dastuurku tilmaamay. Is this SMD with Plurality or SMD with Majority? The word majority should be plurality

 

 

 

PR-- Proportional Representation

 

Have two components – The list system and the cumulative system

 

 

 

The list system-Parties prepare list for the candidate and voter has choice for party but not for candidate. Seats are distributed among the participant parties on the basis of percentage of votes received by each of the parties. Those with large block of votes in the district are elected. This system is giving a suffrage for the citizen but it is not providing empowerment to opt for a candidate. It is the party

 

 

 

The cumulative system –A quota is established for electoral district and only candidates who receive at least the required minimum of valid votes are elected. From all party competitors, the candidates that receive above the quota are awarded as elected, starting from highest voted one to-second highest till fill all posts decadency order. Should few qualified the quota then minimum order quota is implemented.

 

 

 

The way to solve of up coming problem is that parliament should address and amend any legal system that does not fit the following criteria

 

Rules are established for purpose of remedifying in response of need and provide answers for the conflicts and the main of the legal system (Constitution ordinances Municipal) is :

 

 

 

To achieving justice----------- --keeno cadaalad -for all citizens for all citizens

 

To enforce intent---------------- khasb inuu yeelsiyo ujeedada - for all citizens

 

To maintaining peace------------daryeelo nabada - for all citizens

 

To provide protection------------keeno ilaalin -for all citizens

 

To provide answers--------------keeno jawaabo- iska hor imaadyada- for all citizens

 

To provide police power---------keeno awooda booliska -for all employed citizens

To be practical--------------------- la fulin karo

 

To be flexible-----------------------la fahmi karo

 

To be definite-----------------------aan khalad lahayn

To be final--------------------------go’aan ka dambeys yahay

 

 

 

Thirdly this is to cautioning and telling for those who, un-academically equipped and have the opportunity to run the country that there is contract between the government and the citizens is called Social control and the primary function of social control is the binding rules and instrumentalities used by political authority to regulate human activities in order to preserve the stability and continuity of a political system and to pro­tect its basic components. It is equally evident that if social control is not substantially matched by the presence of the six opportunities of free­dom, it may degenerate into a self-serving device of oppression. Experience clearly shows that a balance between freedom and social control existed when and where the constitutional rules and the political ethos safeguard the following "opportunities" for the individual mem­bers of the political community:

 

1. The right of individuals to express views and ideas without previous permission by the political authorities and without fear of later pun­ishment (the only limitations being the norms of generally sanctioned morality or the needs of public safety)

 

2. The right of individuals to organize and establish independent power structures without interference by the political authorities, provided that the activities of the organization do not undermine or obstruct the enjoyment of the same rights by other members of the political com­munity

 

 

 

3. The right to employ procedures for the orderly replacement of the po­litical authorities when there is a change in the prevailing orientations of the political community

 

 

 

4. The right of individuals to have unhindered and easy access to judi­cial agencies that are obligated to apply legal rules equitably, without interference or dictation by other centres of power in the community, thus shielding individuals from arbitrary sanctions or deprivations

 

 

 

5. The right of individuals or groups to take hold of economic resources (property, employment, or control of assets) and use them to increase their own influence and power potential so that they can counter the influence or power potential of other groups, individuals, or, most im­portant, of the political authorities themselves

 

6. The right of individuals to travel, communicate, choose their type and place of employment, their place of residence, and their associations, to have health protection, old-age assistance, security of person and property, and to acquire skills through training and education and to employ those skills for their own benefit without undue interference by the political authorities (social opportunities)

 

When several of those opportunities are totally or partially removed or curtailed, we have a contraction of the diffusion of power, and the bal­ance between freedom and social control is upset in favour of social con­trol. Which has six basic objectives:

 

1. To protect the constitutional framework and assure that it can be changed only through the procedures sanctioned by the constitutional rules.

 

 

 

2. To protect the political authorities from unconstitutional attempts to

replace them.

 

 

 

 

 

3. To protect the citizen from the actions of other individuals that may

cause him bodily harm or loss of property.

 

 

 

4. To protect the public order and social peace from violent actions by individuals or groups.

 

 

 

 

 

5. To regulate the activities of individuals, legal entities, or groups in or­

der to promote orderly relationships, tone down conflict, and advance

the solution of social problems.

 

 

 

6. To assure that the binding rules and decisions made by the political

authorities will be implemented and respected by the members of the

political community.

i believe this conflict has already began.. i know somaliland dont care much about my city -- city of camel milk -- las Anod.

 

but hey, we will fight to end.. however, if you neigbhors house is burning, then logically, u be next.

 

somaliland assumption that they can survive without alliance will bite them in the back soon.
