A word of warning to the world: Genocide in the making in Mogadishu

The Somali Solidarity in North America (SOSNA) clearly sees genocide in the making in Mogadishu. Within three days of heavy shelling and indiscriminate bombardment of civilian neighborhoods in Mogadishu, the occupying Ethiopian troops had mercilessly killed more than 4000 innocent civilians. We remind the world that all this carnage took place within three days of fighting. Those caught in the crossfire and carnage tenfold outnumber the dead.

 

We are not using the word " genocide" loosely here. The mass murder, rampant slaughter of innocent Somalis, the displacement of more than 100 thousand people and the campaign to wipe out whole Mogadishu neighborhoods is comparable to the Darfur Genocide. We perceive the Somali version of the Janjaweed as the Transitional Federal Government (TFG) supported militia from Puntland belonging to the President's clan, numbering 4000, camped in Villa Somalia and the Military academy that are intentionally shelling and targeting heavy artillery into neighborhoods populated by rival clans. This is a calculated clannish vengeance that the international community is unfortunately condoning.

 

Somalis of good conscience completely concur this is the case of clannish enterprise to set scores. We cannot remain silent of the killing of Somalis simply because they are of certain clan.

 

The Somali Solidarity in North America (SOSNA) draws an immediate attention to the surge and re-enforcement of 20,000 Ethiopians troops with their tanks and armored trucks that have already crossed the border towns of Belet-Weyne and Wajid all heading to Mogadishu. There are already more than 25,000 Ethiopian troops now occupying Somalia. There are an estimated 20,000 Ethiopian forces in and around Mogadishu.

 

This is an illegal invasion of sovereign country and it is against all international laws and United Nations Charter. The Somali Solidarity of North America calls the immediate, complete and unconditional withdrawal of Ethiopian troops from Somalia. There is no military solution to the Somali conflict. Only a genuine, Somali owned indigenous solution with no external meddling can restore peace, law, order, and governance in Somalia. Somali Solidarity of North America believes Somali civil society organizations, intellectuals, traditional clan elders, women organizations, business community and moderate religious leaders can pave the way for peace and reconciliation. Warlords and war criminals should not be allowed to participate and be part of any leadership and any peace conference. They belong to the International Criminal Court, not to become presidents, ministers or members of the parliament.

 

There seems to be a terrible scheme of apathy and silence from the international community as it is allowing genocide in the making to materialize. At this juncture, the most deplorable is the lack of concern of the United Nations Security Council and the tacit support of the United States Government. The United States has the influence within the UN Security Council to stop this genocide and to reverse the Ethiopians military surge.

 

A serious and immediate re-examination of the U.S. support of the warlord infested Transitional Federal Government could easily alleviate the magnitude of the mass killings in Mogadishu. The United States must not allow Meles Zenawi of Ethiopia and his forces to reach Mogadishu and carry their planned "wiping out entire neighborhoods".

 

This military madness and surge does not make sense. The pretext of using "terrorist card and/or Islamist insurgence "and labeling a whole community because they oppose the invasion of Ethiopia and the clannish enterprise of the TFG Leadership is not a license to conduct genocide.

 

The Somali Solidarity in North America (SOSNA) is wondering how the democratic, free and civilized world could condone the tragic slaughter in progress in Mogadishu. Where is the humanity, the sense of right and wrong when thousands of innocent civilians, including children, are slaughtered and amputated within the span of two to three days? We are saddened by the fact that not one country from the democratic, free and civilized world is on record for condemning the horrifying Ethiopian crusade of invasion and terror in Mogadishu.

 

The depth of the international betrayal of Somalia and especially, of Mogadishu residents is hard to believe. A Week into the carnage, the international community, the United Nations Security Council and the United States Government are actually insisting their "de rigueur" and unjust support for the Transitional Federal Government. It is distressing that the American tactic support of the Ethiopian invasion is allowing the regime of Meles Zenawi to increase its military occupation and aggression to conduct a severe and sinister campaign of genocide in Mogadishu.

The unusual April cold front didn’t stop hundreds of Somalis from around Minnesota on Saturday to express their anger against what they called the “Mogadishu massacre,”—a recent upheaval of violence in the troubled capital of Somalia.

 

The protest, on Peavey Park, attracted more than a thousand Somalis who blamed neighboring Ethiopia for killings hundreds of civilians over the last two weeks.

 

One of those killed was the 11-year-old niece of Salaado Osman, a Minneapolis mother of two. “What did my [niece] do to deserve this barbaric killing?” she asked. “Was she a terrorist?"

 

Though the violence in Somalia seems perpetual, the most recent conflict was unforeseen, according to the ICRC. Thousands of Ethiopian troops, who pushed their way into Somalia in December, have since been battling clan militia in the worst urban warfare in the city. More than 500 civilians are believed to be dead in the last two weeks, mostly from the massive shelling of Ethiopians.

 

The European Union, which is the chief financier of the embattled Transitional Federal Government, has announced this week that it’s investigating possible human rights and war rules violations by Ethiopians and the TFG. Should that yield traceable evidence, the EU has threatened to bring war crimes against those responsible.

 

For protesters, the evidence was already there, as they chanted: “No more genocide in Somalia,” and held placards that read “USA: stop the genocide.”

 

The U.S. was crucial to Ethiopia’s swift military success in Somalia as it supplied aerial intelligence to Ethiopian troops during the December fighting. And just today, the New York Times reported that the U.S. allowed Ethiopia to secretly buy arms from North Korea, even as the latter was under a U.S. pushed U.N. sanctions.

 

Protestors say the U.S. could equally become crucial in peace-building, only if it becomes an honest broker. “It’s time for the U.S. to promote peace and nation-building in Somalia,” said Ilyas Dahir, a 21-year-old college student from Rochester, whose elderly parents fled Mogadishu for the first time in 16 years. “Unfortunately, the U.S. is supporting the TFG, which is not only complicit in the Mogadishu massacre, but instigated the recent killings.

 

As speakers took turns in the microphone, patriotic songs interspersed, piercing the otherwise quiet Easter weekend. Several women sang “Buraanbur,” a traditional female lyric used during special tragedies or triumphs. Being clearly in a tragic mode, one woman’s “buraanbur” was particularly emotive that dozens in the audience erupted in sobbing.

 

It’s the second time in three months that Somali protestors rally in the Chicago and Franklin Ave. park. The Minneapolis-based Somali Institute for Peace and Justice, which organized the protest, said they will organize similar protests until the “Ethiopian occupation ends.”

AN OPEN LETTER TO THE UN SECRETARY GENERAL: GENOCIDE IS IN THE MAKING IN SOMALIA

Mr. Secretary General:

 

We, Somali Canadian Diaspora Alliance, are writing you because we are convinced that war crimes atrocities have taken place in Mogadishu, the capital of Somalia. This genocide is being perpetrated by the Ethiopian occupying forces with the assistance of the leadership of the Transitional Federal Government of Somalia (TFG).

 

We believe intentional and indiscriminate bombarding of civilians constitutes war crimes, and we urge you to be proactive on this serious matter and investigate the recent blatant human rights violations in Somalia. In the past two weeks alone, the Ethiopian occupying forces using tanks and helicopter gun-ships terrorized the residents of Mogadishu by intentionally and indiscriminately shelling residential neighborhoods in the capital city, causing civilian deaths, extensive property and infrastructure damages and mass exodus of unprecedented scale.

 

International NGOs, local NGOs, and human rights organizations have reported that in the last ten days, more than hundred thousand civilians including children and women have fled from Mogadishu and live in dire conditions in adjacent towns, some even live in open fields and are subjected to harassment and intimidation by TFG militias; such mass exodus is a DIRECT result of Ethiopian bombardment on civilian populations.

 

Mr. Secretary General;

 

The top leadership of the TFG including the President and the Prime Minister has made statements that condone violence against innocent civilians, as the well-publicized and documented self-incriminating admission by the TFG leadership that they are “intentionally and indiscriminately bombarding Mogadishu to fret out insurgencies” clearly indicates.

 

We believe history will not forget and forgive if the international community and the UN in particular, turn a blind eye to the clear and continuing war crimes and human rights violations in Somalia and particularly in Mogadishu by the illegally occupying Ethiopian forces and their TFG allies.

 

Failing to stand up for the innocent and war-weary victims in Somalia is contrary to the Responsibility to Protect – an international principle applauded by and is applicable in the current Somali situation.

 

Mr. Secretary General;

 

The prevailing view among the Somali Diaspora, intellectuals, and civil societies is that the only viable option for a long term resolution is through dialogue and reconciliation among the conflicting parties, Somalia needs a conflict transformation approach that is inductive in nature rather than an approach deduced from existing conflict resolution techniques and standards that has been applied to other war torn countries, the notion that “one size fits all’ is not applicable to the unique nature of the Somali conflict and thus entails its own prescription.

 

Mr. Secretary General;

 

We urge you to heed and consider the following recommendation. In order to find ways out of the current Somali crises, the Somali Canadian Diaspora Alliance proposes that:

1. 1. Ethiopia pull out its troops immediately without any conditions to create an environment that is conducive for reconciliation
2. A neutral peacekeeping force is deployed immediately to help the safe delivery of humanitarian assistance.

Hold a genuine reconciliation conference, in which all the stakeholders are invited, this should be held in a neutral country and should be included civil society, women’s organizations, Diaspora community, UIC. All the stakeholders must participate in the design and planning of the reconciliation conference.

And that the international community investigates any war crimes committed by the Ethiopians and the TFG.

War crimes committed in Mogadishu by Ethiopian and TFG troops should be thoroughly investigated

Nine days ago, Ethiopian and Somali Transitional Federal Government (TFG) troops launched a military offensive in densely populated areas of Mogadishu, against the opponents of the Ethiopia’s occupation of Somalia. These military operations were ostensibly aimed at disarming some segments of Mogadishu population while other parts of Mogadishu/Somalia are still awash with weapons. Some clans in Mogadishu resisted the disarmament drive, which they saw as an unfair campaign to target certain particular clans. The fierce fighting that ensued claimed the lives of hundreds, if not thousands, of civilians. The International Committee of the Red Cross described the fighting as the worst in Mogadishu in 15 years. The decomposed bodies of the massacred civilians are still being retrieved from the conflict area, and some unburied dead bodies are still lying in the streets as we write this press release. The UN secretary-General said in a statement that he was “particularly concerned about the use of air strikes and the introduction of tanks and heavy artillery into densely populated parts of the city”. Furthermore, hundreds of thousands of civilians fled their homes and are displaced in and around Mogadishu- facing imminent humanitarian crises if not assisted immediately.

 

There is growing evidence, collected and documented by local human rights organisations and the independent media, that Ethiopian troops and their Somali Transitional Government allies purposely and indiscriminately targeted and shelled thickly populated civilian neighbourhoods in parts of Mogadishu. As a result, more than 1750 civilians are either killed or wounded. This is an obvious breach of Geneva Conventions. In accordance with the international humanitarian law the parties to a conflict must always make a distinction between the civilian population and fighters in order to spare the civilian population and civilian property. Attacks against the civilian population whether collectively or individually are proscribed. In that respect the warring parties are legally obliged to guarantee that “The civilian population and individual civilians shall enjoy general protection against the dangers arising from military operations…”. Furthermore, international humanitarian law demands that “The civilian population as such, as well as individual civilians, shall not be the object of attack. Acts or threats of violence the primary purpose of which is to spread terror among the civilian population are prohibited.” [2] The aforementioned breaches of Geneva conventions constitute war crimes pursuant to article 8 of Rome Statute of International Criminal Court.

 

The highest officials of the Ethiopian backed Transitional Government including the president and the prime minister, on numerous occasions, have shown an apparent disregard for the protection of civilians and admitted over and over again that they intentionally target civilian neighbourhoods whenever a singe bullet is fired at their positions from civilian areas. This is also a clear case of collective punishment in violation of humanitarian law. Likewise,

Ethiopian troops intentionally shelled and occupied Hayat hospital in contravention of their legal obligation to spare civilian medical facilities. A doctor told AFP that Ethiopian troops raided Hayat hospital collected all the medicine and also detained one of the doctors

. Article 18 of the Fourth Geneva convention stipulates that “ Civilian hospitals organized to give care to the wounded and sick, the infirm and maternity cases, may in no circumstances be the object of attack but shall at all times be respected and protected by the Parties to the conflict.[3]” The shelling of Hayat hospital is, without any doubt, a flagrant disregard for humanitarian law and thus amounts to war crime in accordance with article 8 of Rome Statute of International Criminal Court. It is evident from the foregoing that very serious gross human rights violations are committed by Ethiopian occupying forces and the militia of the Transitional Federal Government. The nature and the scope of these violations and the breach of international humanitarian law warrant war crimes investigation.

 

In light of the above SHRC:

• is convinced that the illegal presence of Ethiopian troops in Somalia is a primary source of instability. To that end, Ethiopian troops should withdraw from Somali territory without any delay or precondition.
• is dismayed by the silence of the international community towards the massacre perpetrated against innocent Mogadishu civilian population- not withstanding vague calls for reconciliation and condemnation of shelling of civilian areas. We believe that such a disgraceful silence will encourage Ethiopian and TFG troops to commit more crimes against Somali people in the not too distant future.

commends the initiative taken by the European Union to investigate the war crimes and crimes against humanity perpetrated against Somali people in Mogadishu. We urge the United Nations and other international as well as regional organisations to follow suit and launch an impartial and thorough inquiry into the gross human rights violations and blatant breach of Geneva Conventions committed against Somali civilian population.

Stop the Current Brutality and the Indiscriminate Slaughter Campaign in Somalia

In light of the brutal and indiscriminate slaughter campaign unleashed last week by the Ethiopian occupational forces backed by militias loyal to the Transitional Federal Government (TFG) that left hundreds of corpses decaying in the streets of Mogadishu- an atrocious carnage described by the ICRC (International Committee for the Red Cross) as “the worst in the past 15 years”;

 

In light of the horrific first-hand testimonials and reports of gross human rights abuses against civilians who were raped, looted, and cruelly beaten;

 

In light of the thousands more who were left in a helpless anguish, suffering the pains of their injuries amidst the ruins, in back allays, and in the corridors of hospitals operating over capacity;

 

In light of the tens of thousands more who were forced onto mass exodus-- fleeing to other Somali regions already declared disaster areas for dire food shortage and rampancy of cholera as a result of recent floods;

 

In light of the manifest failure of the Ethiopia’s artificial mission of “stabilizing Mogadishu” and “enhancing security” as it caused unfathomable human sufferings, aggravated old wounds, and made matters more volatile than ever;

 

In light of the lack of political will on the part of the international community (save sporadic symbolic gestures) to stop the unfolding humanitarian disaster in Somalia- a matter that Simon Tisdall of the Guardian newspaper aptly described as “the hidden shame of the world”;

 

We, the Steering Committee of the North American Somali Diaspora, call upon the international community; namely, the United Nations Security Council, the United States, the European Union, the African Unity, the Arab League, and indeed the International Contact Group to help resolve this matter before it evolves into a deadly sectarian catastrophe that affects the entire Horn of Africa.

 

We believe that a viable resolution is attainable, especially since the emergence of certain intra-Somali dynamics.

 

In recent months, upon witnessing the difference that a six months of peace and relative order have made in war-ravaged Mogadishu, Somalis, by and large, became motivated out of their paralyzing sense of cynicism, particularly, the previously detached Somali Diaspora.

 

The Somali Diaspora is now more organized than ever before- they are awakened from their deep slumber and are now reclaiming their rights as stakeholders who could help shape the political, social, and economic future of their country.

 

In conclusion, we believe, unless and until the following steps are taken, any proposition for attaining political resolution and lasting peace would be, at best, a costly political mirage…

 

1) Lasting ceasefire that is monitored by the UN is established.

 

2) Ethiopia is ordered to pull all its troops out of Somalia as stipulated in UN Security Council Resolutions 1725 and 1744.

 

3) The Ethiopian forces are promptly replaced by an international, Blue Beret troops that include contingents from Islamic countries.

 

4) The upcoming “reconciliation conference” being organized by the TFG is suspended, and instead, a genuine Somali-driven reconciliation process with the supervision of the international community is sought.

 

5) An independent reconciliation commission is assembled to manage the conference.

 

6) The opposition members of the Transitional Federal Parliament members are brought back and are provided security to carryout their duties as elected members of the legislative branch of the Transitional Federal Institutions.

 

7) Moderate leaders of the Islamic Courts Union are secured seats in the reconciliation process.

 

8) The TFG (not the TFI) partakes in the reconciliation as a party in the conflict; not as the host or the mediator.

Introduction

 

The European Union (EU) and the United States have “urged” Somalia’s weak and illegitimate Transitional Federal Government (TFG) to negotiate with ‘moderate’ elements of the Islamic Courts and other stakeholders in order to form a broad-based and inclusive transitional authority which can advance reconciliation and secure the peace. Such a push by the USA and EU is a tacit recognition that the TFG is illegitimate. The EU, unlike the United States which has supported Ethiopia’s invasion of Somalia and which has endorsed the TFG, informed the latter that it was not prepared to release funds to help the country unless the latter committed itself to the creation of an inclusive government. In response to the EU’s demand several TFG ministers traveled to Brussels and reported to the EU that the regime was ready to organize the reconciliation conference in Mogadishu. Although all the details are not known it is clear from the regime’s proposal that it will invite 3000 delegates and manage the convention.[ii] The EU appears to have accepted the proposal and the ministers returned to Nairobi/Baidoa in a cheery mood. Since then, the TFG leader has declared that the invitees will be solely clan elders and representatives, and a sprinkling of others. These developments have generated some excitement among the TFG and donors, however, if the reconciliation project proceeds along the lines imagined by the TFG and the funders it is highly unlikely that the affair will bear fruitful peace and garner legitimacy for the regime. This dim prospect for reconciliation has been destroyed by the indiscriminate mass murder of Somalis by the Ethiopian forces in and around Mogadishu The Ethiopian offensive has completely shattered any possibility for the TFG gaining any acceptance from the Somali people. In other words, the TFG is dead but Somalis must move forward with positive reconciliation.
