Forget the issue of the kurds, Saddam and his sons were reeking havoc on the Iraqi public for years and years without the help of anyone. They thought they were invincible, what ever humiliation he suffers through the hands of the Americans he deserves it. Injustice is injustice regardless of who does it. I don't know who his executioners are, but if the Americans haven't handed him over to the Iraqis as of yet, the probability of him not being executed and getting smuggled out of the country is pretty high. People raised the same criticisms about Saddam's court hearings not being fair and his judges not being competent enough to sentence him. But who really cares.
