Che -Guevara Posted October 10, 2010 We, African Rights Monitor (ARM) want to express our concern about the arrest, trial and subsequent imprisonment of Mr. Abdifitah Jama, the Director of Horseed FM radio in Bosaso, Somalia. ARM wants to express its reservations about the circumstances under which Mr. Jama was arrested and the nature of the charge leveled against him. ARM wants to draw attention to the hasty trial and verdict of Mr. Jama’s case. Mr. Jama was tried and convicted within the same day; this timeframe did not give Mr. Jama’s defense team enough time to investigate and prepare for the case. Such hasty trial violates international laws and denies Mr. Jama the rights granted to him under Puntland’s Constitution and the Constitution of Somalia’s Transitional Federal Government. The evidentiary rules used to convict Mr. Jama do not meet the legal standards of any jurisdiction and as such Mr. Jama’s punishment is exceptionally harsh if not outright illegal. ARM urges the President of Puntland, the administration and the courts to grant a fair trial where the circumstances of his arrest and charges against him are clarified, and where the evidence against him is presented to his legal team and the media. ARM urges the courts to give Mr. Jama’s defense team the necessary time to gather evidence and prepare for the case. ARM appeals to the President of Puntland and his administration to safeguard the well-being and the security of Mr. Jama while he is under the custody of Puntland’s Prison System. It is our hope that the administration and the courts will give Mr. Jama’s family and legal team free access to him. This guy attempted to undermine the authority of the state, when he deliberately aired terrorist propaganda on Horseed Radio, even though he was explicitly instructed to avoid such an offense. He thought he was above the law and now the law is merely humbling him and NOT all the pictures of his female relatives and children will help him now.
