N.O.R.F Posted August 13, 2007 A Charlotte, NC, lawyer purchased a box of very rare and expensive cigars, then insured them against fire among other things. Within a month having smoked his entire stockpile of these great cigars and without yet having made even his first premium payment on the policy, the lawyer filed a claim against the insurance company. In his claim, the lawyer stated the cigars were lost "in a series of small fires." The insurance company refused to pay, citing the obvious reason: that the man had consumed the cigars in the normal fashion. The lawyer sued and won. In delivering the ruling the judge agreed with the insurance company that the claim was frivolous. The Judge stated nevertheless, that the lawyer held a policy from the company in which it had warranted that the cigars were insurable and also guaranteed that it would insure them against fire, without defining what is considered to be "unacceptable fire," and was obligated to pay the claim. Rather than endure a lengthy and costly appeal process, the insurance company accepted the ruling and paid $15,000.00 to the lawyer for his loss of the rare cigars lost in the "fires." Khayr Posted August 14, 2007 Salams, They are all crooks! Crooks... The Insurance company for selling insurance for a box of cigars. That was a definite high risk item and greedy broker who sold that policy should have his licence revoked and be banned for life from selling insurance. The greedy lawyer for knowing that the policy was absurd and committing fraud. He should be disbarred for such unethical practices...but ofcourse he won't be because the blame lays in the 'ambiguity' of the insurance policy. This might be a simplified and an extreme case of abuse of the judicial system; however, this is common practice in law. Court cases are dragged on for years based on jurisdicational issues and technical terminology. There was recklessness on the part of the lawyer and this should have been a frivolous claim thrown out the court. The Judicial system is rot with foulness and corporate America is a master at this. Having a strong legal department in your firm is absolutely crucial. I have seen some examples were in the individual had excellent cases but were dismissed in a court of law because some solicitor raised jurisdicational issues. Its a foul world out there....
