  2. Here is a report by Rutledge, former English Professor of the University of Chicago. Rutledge writes, "In Malta, people are held in detention for over a year, where they are regularly beaten. The sanitary facilities in detention are inadequate, so people are constantly getting sick, but they very poor medical attention. There is no separation between men and women, so rape is a frequent occurrence, and if Somali men attempt to protect their sisters from rape, fights start, and more beatings occur”. Still, Rutledge says, “when he got out of detention, Hassan was hopeful. He thought that in Europe, humanitarian agencies would help him find his family; he could reunite with them, and he could get on with his life. Unfortunately, this was not the case. In Malta, a Catholic country, the form of subsidiary protection offered is called Humanitarian Protection, and it is a form of charity. There are no rights as there would be under the Geneva Convention”. So Hassan did not have the right to family reunification and does not have the right to work, as he would under the convention, reports Rutledge. He says, “In Malta, it is almost impossible for Somali refugees to find work. When they do, the job only lasts for a few days at a time. The Somali person will inevitably be paid a third or less than what a Maltese would make for doing the same job. Moreover, if a refugee’s employer refuses to pay him, he has no recourse. Hassan’s employer would not pay him for five days work. He complained to the police, who simply reminded Hassan that he was African and had no rights in Malta”. In his report, Rutledge writes that Hassan then “went to the refugee commission run by the Church, where the priest told him he would help, but nothing was done. So Hassan, who is forty, is living in what is called an open centre, with hundreds of other refugees. The sanitation is terrible, the living conditions are hot and uncomfortable, but he cannot leave this small island, where racism is rampant. The Maltese actually want Hassan and all other refugees to go. They even give them travel documents, but Hassan is clearly not going to pay the smuggler to take him back to Libya, and the Europeans will not let him enter”. Rutledge goes on to write, “if Hassan were to go to England or Holland and apply for asylum, he would be sent back to Malta. He could attempt to live underground in England, for example. He would have to work illegally, and he could not ask for medical care. This is exactly the problem. Sooner or later, through a medical need, a traffic accident, or simply the wrong conversation, Hassan would come to the attention of the system, and when he did, he would be sent back to Malta”. Europeans believe that they can discourage Somalis from entering Europe by using the Dublin Regulations to keep them in countries where life is terribly unpleasant, Rutledge writes. He then says that he interviewed people who consistently told him that they left because conditions in at home became such that they would either have to kill someone or be killed themselves. It has no moral case since it's one Somali clan whose fiefdom does not stretch further their clan territory. It has no legal justification since it was never conceived as a state. It's a region only defined by its shameful colonial heritage--with all its historic atrocities against our people. Even so, Britain's military rule after WWII in Somalia can be said to be a defining feature of Somalia's colonial past. Of course, the Arab states like many other African and Asian states respect our territorial integrity, but there's no strong case before the international community to warrant the dismemberment of Somalia, neither moral nor legal.

Was it different from the light blue with a star in the middle? 2. Which countries recognized their juridical claim to statehood, name one or two. 3. Was the independence granted by Britain in preparation for the union of two Somali regions or the disunion thereof? Does Somaliland have the normative legitimacy to their quest for statehood? Only a few cases of secession from existing member states of the United Nations were legally recognized as possessing normative legitimacy for their acclaimed right to an external self-determination , and those few cases came from states or empires constitutionally arranged as federal systems. Federally arranged states partly disintegrated owing to egregious violations of their federal charters prior to their legal merge. For instance, Eritrea was an autonomous unit federated with Ethiopia under the sovereignty of Ethiopian Crown, and the ratification of their subsequent agreements was sanctioned by the U.N. Therefore, these unique territories (such as the Baltic states, Eritrea, and East Timor) under states constitutionally arranged as federal systems, possessed legitimate struggle against annexation, not secessionim struggle because the administrations of the states with which they were federated dissolved the federal agreements protecting their religious and linguistic rights as well as their widest measure of self-government. Besides the population in these new states were demanded of absolute loyalty and to submit to other assimilationist pressures for reasons of state integrity and security. According to Raymond C. Taras in his. article Ethnic Conflict and International Norms, he captures the legal exceptions to the international normative regime on secession. “Between 1945 and 1990, many separatist movements existed, but only one-Bangladesh—succeeded. In the early 1990s, a number of successful secessions did take place, but they were mostly concentrated in Communist states that were organized as federal systems and were in the throes of collapse. (2) Evaluating further on whether “Somaliland” had possessed the attributes of statehood based on the history of the legal merger of the two regions of Somalia, let us revisit the Covenant on the Civil and Political Rights (CCPR), and the UN General Assembly Resolution 1514(XV) of 1960, the latter was implemented through the Charter-based mechanism. In an analytical framework to the time when both British and Italian Somaliland were granted independence and merged thereafter, one would come to know whether the break-away entity of Northwestern Somalia ever transpired into a state of its own. Under article 1 of the CCPR, the subjection of peoples to alien rule and exploitation violates the UN charter, so it can be said immediate steps were taken, in non-self-governing territories (Colonies), to transfer all powers once and for all. Article 6 of Resolution 1514(XV) also proclaims that, after the transfer of all powers in non-self-governing territories to the people concerned, disruption of the political and territorial integrity of a country formed subsequently is incompatible with the charter. As it is evident from the widespread protest demonstrated by our leaders in 1959, the Legislative Council in Hargeisa appointed a commission to represent their voted resolution passed on April 6, 1960 by the elected members of the Protectorate on their political desire and heartfelt aspiration for an independence and immediate union with Somalia(3). Britain was quick to acquiesce to such popular demands though it regretted the short interval of timing under which the responsibility of the protectorate were to be transferred to Somalia. Another important document states that widespread political protests arising from the secret liquidation of the Hawd Reserve to Imperial Ethiopia forced Britain to “accept the eventual unification of British Somaliland with Italian Somaliland,” (4). Whereas the newly formed state of Kosovo possessed the attributes of autonomy under federal Yugoslavia, Somaliland had possessed no such attributes of autonomous status. Kosovo had its own separate assembly, police, and bank until 1990 when Serbian rule was imposed on them that repressed the ethnic Albanians who are ethnically distinct from the Serbs. The existence of historical rivalry and animosity between the two also dates back to the Ottoman period. For instance, Muslim Albanians were in better position than the Serbs. A further root cause of their conflict was when Albanians allied with Germany and Italy during WWII in their quest for pledged “Greater Albania” during which Muslim atrocities against the ethnic Serbs occurred. I don't know why his guarded inner conviction and outward endorsement of this contraversial issue of seperation greatly differ. At the present it does only function in limited scope with the provision of social needs and emergence situation response but the declaration of a governing system lack the complete consensus needed within the Maakhir communities at home and abroad because of conflicting priorities.   20. ^That's not logic but exploitation and direct violation of ILO labor rights. Greed by the strong over the poor and the uneducated destroys the welfare and the moral fabric of our social values. Therefore, it's imperative that th UN press the UAE Government to adopt the ILO convention just like Fiji did. Granted It's big lure for construction companies under Government contracts, but they should come with favorable labor terms and conditions and respect for human rights. Sweatshops created by transnational companies weilding economic and political influence on the host nations still mushroom in Asia, Africa and latin America. But at this particular case, it's too harsh and hopeless. It makes you wonder as if it came at the suggestion of the advisors and experts and managers at the second tier in this stratified system of economic relations in Dubai to bring in foreign workers from poor nations. There are even scam employment agencies perpetuating these bleak conditions. I remember reading an article back in 2004 about a contract the US Government entered with Haliburton and its subsidiary. The contract was about building a security zone. To save money and eliminate the cost of input materials and equipment, the construction company under sub-agreement with Halliburton illegally hired thousands of Iraqi laborers and it exploited them in the most despicable condition. It was later discovered and they passed a law thereof with strict enforcement and penalties.

  22. Nin Yaaban, I disagree with your conclusion. Somali women give birth an average of 8 kids and above, even in the Diaspora. I do agree however that the rate of sustainable family as an institution is rare or fading in the Diaspora due to many factors. Either the young are too financially strapped or restricted by the inflexibilty of our cultural demands. There's however a growing trend back in Somalia that are beneficial to our population growth in the long run. Our society is becoming more religious, thus the number of young sheikhs having a large family is rising to a significant level. I was reading a report in which a local NGO reported an unprecedented increase in the # of population figures in some villages from 2-3 years point. If we open more children's hospitals, discourage risky migrations and work towards a sustainable peace in the south like the north and create opportunities for the unemployed, we will be fine in as far as our society's preservation is concerned. Btw, my own uncle has over 30 kids in back home. But a man named Salaad Dalmar, I was told, has 45 boys from four wives, each having 12. What is miraculous about them is delivering the same double digit and boys. Unbelievable! Lol
