Somalia: EU Monitors Constitution Making Process, Puntland Reaffirms Position. Garowe (9th May-2011) A team of EU Monitors sent out to collect an independent overview of progress for EU funded programs in Somalia, visited stakeholders in Puntland, a stable state in Somalia. The State Minister of the Puntland Presidency for Democratization and Federal Affairs HE Dr. Abdi Hassan Jimale (PhD) received EU Monitor Mr. Douglas McLure and Mr. Phillip Cooper, the UNDP Deputy Manager for the Somalia Governance Program in his offices at the Puntland State House. Mr. Mclure visited Puntland to look at support provided by UNDP to the federal constitution making process, the position of Puntland on the constitution making process, and strategies for the way forward in the future. Responding to the EU monitors inquiry, Dr. Jimale presented issues that adversely affected Puntlands participation in the constitution making process. The State Minister pointed out the key issues as the categorical exclusion of Puntland from the federal constitution making process and the IFCC, the TFGs boycott of the federal constitution launching in Somalia, and the TFGs practice of a unitary system of governance facilitated by the incorrect assumption held by the international community that the TFG represented the entire Somalia. No representative from Puntland participated in this process. Dr. Jimale reiterated. The TFG is responsible for the mistakes and the UN did not correct the mistakes, Dr. Jimale said. Since the international community funds this process, it is responsible for its management. Position on the Constitution Making Process Personally, I think the process is Utopian and a waste of resources, Dr. Jimale said. We refuse to be part of a clan-based process; a process that has illicitly replaced Puntlands learned delegation - to the constitution making process - with immature candidates of their choice. The position of the Puntland government remains the same; we have pulled out of the process and opened a window of opportunity for corrections in the future Dr. Jimale said. The State Minister said that Puntland would seek for inclusion in the constitution making process and embark on the harmonization of the federal and the state constitutions in the future. Recommendations put forward to address challenges facing the 14th constitution making attempt in Somalia included a call for stakeholders to hold serious discussions with the TFG, a tripartite arrangement was recommended for the future and the inclusion of all stakeholder as a key step in accelerating progress and sustainability in the process . The recommendations presented by the Puntland government are in line with resolutions adopted by the EU Councils 3076th FOREIGN AFFAIRS Council meeting conclusions on Somalia, in 2011.

Last week Dr. Augustine Mahiga, the UN Special representative to Somalia came to Garoowe to hand a personal invitation to Puntland and it's leader foremost the President Dr. Abdirahman Farole an invitation to the Nairobi Conference whereby the Stakeholders in Somalia will consult on the way forward to final peace and the transition into a proper Somali government that is not managed by the UN. Somalia has been in transition since 2004 and had for the last 7 years only an interim government. The Nairobi Conference is a chance whereby Somalis can come and sit together to agree on how they could manage that transition and the agreed power formula of 4.5 changed. We all know that Somalia needs a new beginning starting with a new leadership in place. We also need a new and more democratic formula and for once and all drop the 4.5 which is a shameless formula adopted in Arte Djibouti in 2000. We also need to agree on the draft consultation and sign it so that the powers of the President and Prime Minister if there's one to begin with which had been a prime factor of this current TFG's inner fightings and disputes to be settled at once and all. Everyone then would have a clear path and work frame to attend to. Puntland thus proposed a road map on how Somalis could manage that transition and how a self governing and self reliable government that is lasting and proper can be achieved. For this to have success we need all other Somali stakeholders to contribute to their best of ability, with recommendations, proposals and ideas coming from these stakeholders and present it in Nairobi's April conference.
