By ANDREW ROSENTHAL The federal government managed to hunt down, arrest, charge, try, convict and execute Timothy McVeigh without junking due process. When Jared Lee Loughner attempted to assassinate Rep. Gabrielle Giffords, and shot dead a federal judge and a 9-year-old, grandstanding lawmakers did not demand that he be taken into military custody. Nor did they make that demand when James Holmes was arrested for killing 12 people and wounding 70 others at an Aurora, Colo., movie theater. But now Senator Lindsey Graham is calling for Dzhokhar Tsarnaev to be classified as an enemy combatant and “held and questioned under the law of war,” without a lawyer. What’s the difference? The Boston Marathon bombings are closer to the colloquial and legal definitions of terrorism than the Aurora shooting, but not the Oklahoma bombing, or the Arizona attack. The real difference is that Mr. Tsarnaev is a Muslim, and the United States has since the 9/11 terrorist attacks constructed a separate and profoundly unequal system of detention and punishment that essentially applies only to Muslims. Mr. Graham and others who are demanding that prosecutors treat Mr. Tsarnaev differently from Mr. McVeigh are not even trying very hard to disguise the fact that they’re drawing distinctions based on religion and ethnicity. “You can’t hold every person who commits a terrorist attack as an enemy combatant, I agree with that,” Mr. Graham said. “But you have a right, with his radical Islamist ties and the fact that Chechens all over the world are fighting with Al Qaeda.” There is no known evidence of “radical Islamist ties.” As Senator Dianne Feinstein said on Fox News on Sunday, “This came at this point from two individuals. That’s what we really do know. We do not know what their connections are.” The younger Mr. Tsarnaev is an American citizen. He came here as a child, and never traveled to Chechnya. To repeat: The argument that we should treat Mr. Tsarnaev as an enemy combatant boils down to his religion and his ethnic origin. This is the kind of logic that led the United States to imprison Japanese-Americans during World War 2, and to far worse acts of ethnically and racially motivated violence in other countries. Should the Boston police be rounding up every Chechen who lives in the area and turning them over to the military for questioning? If Mr. Tsarnaev is guilty of the bombings, then he committed a heinous crime, an act of terrorism under American law for which there are severe penalties, including execution. The federal judicial system has put hundreds of people into America’s toughest prisons on charges exactly like the ones he is likely to face. The Supreme Court ruled in 2004, in the case of Yaser Esam Hamdi, that the United States has the right to hold an American citizen as an enemy combatant — when he is captured on a battlefield in another country. The author of that decision, Justice Sandra Day O’Connor, went out of her way to mention the “narrow” applicability of the ruling. So far, the White House and the Justice Department have said they will charge and try Mr. Tsarnaev in federal court. They have said they will not treat him as an enemy combatant.   7. Oodweyne, Your analogy would have been quite fitting if this wasn't a trend- we are not talking about the usual one liners or a passing commentary here and there. We are talking about a pattern. It is bordering obsession. At times , it comes across as though our brothers in the North stopped reading Somaliland news , and read only news portals that heavily report on Southern matters. So it is not an empty argument- but it is tricky one as it requires a deep soul searching and reexamination

Oodweyne, A Yusuf, however one disagrees with him, was a transformational leader. He was not a mere transactional as Siilaanyo is. He dared to dream big and change Somalia. And he did. You can debate about the means he utilized and casualties he left behind. But that is what it means to be a leader. Don't look any further, your reference to him day in and day out signifies his historical impact on Somali politics. He did not die Mohamed Farah's death, he died big with dignitaries coming from near and far. You have to yet produce an equal Hanibal like him. So stop talking about the dead waryaa. Now as far as Kismayo goes, yours was and still is nothing more than an expression of raw emotion about those whom you still hold accountable for your political wounds. It is unbecoming from a man of Hawd like you, that you still carry the scars of yesteryear's wars. Move on, and accept the political genius that is Kismayo.

The poster has made an excellent observation about this trend. The questions are asked in a very civil way. Number of separatists brothers has shown up in the post, only to go on a tangent, and when subjected to Illyria's rigorous and unforgiving queries, they either exited or in the case of Xaaji Habaar started farting about Youtube clips You have it in you awoowe, so can you be the first taker of Illyria's question?

  14. Gaandhi has secured a golden page in Jubbaland history --no elections can take that one away from him. But Modabe has shown a very impressive leadership qualities. He was the governor of this region under the Islamic Courts before. When alshabaab emerged as the dominant military and political force in the South he was the only leader who defied them and fought them. And regarding current initiative, he was able to bring all communities in the region under the Kismayo tent. He deserves to be given a chance to continue that leadership.

  20. ^^Not sure if you are reading what I am writing . I guess it is the Sal-Fudayd part in your gene that fails you. We are not in disagreement with respect to the role of international community, particularly the powers that be. All I am saying is there is no reason to expect that the powers that be will change their long standing strategy to treat Somalia as one country. The only change we see is an effort to revive that failed state. I think you are misreading the geopolitical reality, it does not permit an dismembered Somalia. If you really believe Somalis have nothing to do with Somaliland fate, then you are more delusional than I thought.
  21. ^^Of course if one succeeds to sell his version of argument to the powers that be, one can indeed move the needle as it were and advance his larger cause. However, despite the significant rise of Somaliland's profile in Ankara and London, and perhaps in Washington as well, the argument they are trying to sell is an old one , and I am not sure how they can square the circle in terms of legal precedent and regional political realities that are stacked against them. By any angle you look at it, the issue of Somaliland's separation will have to be decided by Somalis. And that is something you will find almost impossible to attain a favorable outcome from it.
